Deputies rejected the question for the referendum on the gaming zone
The regional Duma`s Committee on lawmaking, state development and local self-management has considered the conduct of the referendum on liquidation of the gaming zone in Kaliningrad region. As it was reported before, the initiative group of 20 people headed by Lyudmila Ryabichenko worded the question tor the referendum: “Do you think that Kaliningrad`s regional Duma shall appeal to the RF State Duma with the lawmaking initiative on amending the Law # 44-ÔÇ “On state regulation of activities involved in gambling organization and arrangement…” by removing words “Kaliningrad region” from p.2 Clause 9 Chapter 2?”
The election committee of Kaliningrad region acknowledged toe initiative to be legal and sent the corresponding judgment to the regional Duma. However, the expert evaluation of the State and Legal Board of the regional Duma, on studying the appeal, came to an unfavourable conclusion. The matter is that only the matters in the competence of the RF constituent entity may be brought up for the referendum of the RF constituent territory, whereas the creation of gaming zones is in the competence of the RF Government. Furthermore, referendum questions shall be worded in such a manner that would eliminate the possibility of their multiple interpretation and ambiguity of legal consequences.
Having listened to the arguments of the State and Legal Board, the deputies agreed that the question offered for the referendum , is contrary to the law of the Russian Federation.
